Judge Cleland says that the last witness to be called by prosecution will be called at 10 A.M. Until then, the Sandusky Defense Attorneys will present multiple motions without the Jury present.
The first motion was to have some charges dismissed against Sanudsky. Karl Rominger cites that the Defense is having a difficult time nailing down its defense because of a lack of specificity in regards to when the alleged child abuse occurred. Rominger says tehre are multiple witnesses who the defense can call to establish an alibi. An alibi would suggest it was impossible for Sanudsky to commit acts if he was elsewhere.
The Commonwealth responded saying, "The Commonwealth doesn't have to present specific dates of a crime (based on case law)," said Frank Fina, of the Attorny General's Office.
The commonwealth did drop one specific charge in regards to Accuser #6.
The judge denied all Sandusky motions to dismiss charges. Others included that the Attorney General's office didn't establish that the crimes happened in Centre County.
