Defense Attorney Claims Illegal Search And Seizure In Murder Probe Of Teenager

Kingston, Luzerne County--   Attorney Peter Paul Olszewski insists that State Police did an illegal search at the home of Cody Lee in 2009 and that led to evidence that Olszewski argues will not be seen by a jury. Olszewski said, "There was a 100 percent illegal search by the investigators and at the proper time the appropriate motions will be filed in Luzerne County Court. The evidence includes a supposed "to do list" penned by Lee with plans to kill his great grandfather Herbert Lee as well as his father Scott Lee in December of 2009. Luzerne County Assistant District Attorney Sam Sanguedolce fired back at the allegations made by Olszewski and said, "Our investigators did the proper thing when they served the search warrant. Everything they listed on the search warrant affidavit was recovered in that house. His claims of prosecutor misconduct are simply out of line."
