In 1983, a Luzerne County jury ruled convicted mass murderer George Banks should be put to death for his crimes.
Now, nearly 23 years later, a Luzerne County judge says he should not.
The ruling came down Monday morning from Judge Michael Conahan, who says Banks is not competent enough to be executed at this time because of mental illness.
Banks` attorney, Al Flora, says most likely there will be more appeals and the D.A.`s office says they`re already in the works.
