Round Two And This Time Teen Sent To Trial For Murder

Kingston, Luzerne County--  19 year old Cody Lee said nothing as he was brought to District Court in Kingston Friday morning. It was his second preliminary hearing on murder charges. Prosecutors say he shot and killed his great grandfather 80 year old Herbert Lee inside a home they shared in Lake Township in December of 2009. District Judge James Tupper ruled after the first hearing that there was not enough evidence to send Lee to trial. The second hearing was a different story as prosecutors presented two new witnesses.  Cody Fox a friend of Lee and Scott Lee, Lee's father. Fox testified about a "to do list" he saw in Lee's notebook detailing the murder. Scott Lee told the court how he found his son in a darkened home with a rifle and that he wrestled the gun away from his son. Judge Paul Roberts ruled there was enough evidence to send Lee onto Luzerne County Court for trial on murder charges.
