.He is suing Penn State for $4 million dollars claiming he was wrongly fired..Mcqueary was not in
Centre County Court Friday..but his lawyer..Elliot Strokoff was.
He told Judge Gavin that the civil case should not be delayed because it is not connected to the criminal case..and that his client's reputation continues to be harmed...
.Penn State Attorney Nancy Conrad...argued that the university may not be able to obtain necessary documents to defend itself because of the Criminal Cases against Tim Curley, Gary Schultz and former president Graham Spanier who were recently indicted as part of an alleged Cover-up of Silence in the Jerry Sandusky Sex Crimes investigation
Attorney Conrad said: "We may not be able to question Mr. Curley, Mr. Schultz or Mr. Spanier because they may fear incriminating themselves prior to their criminal trials.."...
Attorney Strokoff insisted: "Everyman has the right to defend his reputation..and to clear his name in a timely matter"
McQueary claims that comments made by former president Graham Spanier...just days after Curley and Schultz were indicted in November of 2011..supporting both men..and then his subsequent dismissal shows an intent on the part of Penn State to make McQueary a "scapegoat' in the Sandusky case....
Judge Thomas Gavin says his ultimate concern is to protect the rights of all those involved in both the civil case and criminal cases.. He says he will make a decison within two weeks
